ORDER

This writ miscellaneous petition has been filed by the petitioners/respondents 5, 8 & 12 seeking to recall the order made in W.P.No.34866 of 2025 dated 16.09.2025.

2.Learned counsel for the petitioner would submit that under the pretext of the order of this Court dated 16.09.2025 in W.P.No.34866 of 2025, the petitioner is making an attempt to fence the subject property without the consent of the petitioners herein. Hence, the present writ miscellaneous petition is filed.

3.Learned Additional Government Pleader appearing for the respondents 2 & 3 and the learned Government Advocate appearing for the 4 th respondent would submit that the possession of the property is under dispute and such dispute has to be agitated before the Civil Court. 4.It is made clear that, this Court vide order dated 16.09.2025 in W.P.No.34866 of 2025, directed the respondents 2 & 3 to dispose of the 1 st respondent's representation dated 06.08.2025, on merits and in accordance with law, and if there is any obstruction for fencing the property, the Official respondents are directed to complete the survey with the aid of the Police. However, since there is a dispute regarding the possession of the subject property, the 1 st respondent has to approach the Civil Court and prove his entitlement in the subject property.

Such being the case, the parties are directed to workout their remedy before the appropriate Civil Court and till then the possession of the petitioner shall not be disturbed. It is also made clear that the order of this Court dated 16.09.2025 in W.P.No.34866 of 2025 is recalled to the extent of fencing alone and the surveying the subject property stands confirmed.
