Respondent(s) PRAYER:- Writ Petition filed under Article 226 of the Constitution of India, praying for an issuance of Writ of Mandamus, directing the respondents to commence and complete the land acquisition proceedings for the lands utilized for construction of diversion canal to Adyar river, near the Check Dam, more particularly in Plot Nos.24, 26, 27, 28, 211, 212, 213, 229, 230, 231, 232, 233, 234, 235 and 236, Lakshmi Katatsam Nagar, comprised in Survey Nos.81/2 and 82 of a total extent of 13,306 sq.ft. at No.34, Varadharajapuram Village, Kundrathur Thaluk, Kancheepuram District, pursuant to the administrative sanction granted in G.O.(Ms) No.37 dated 13/06/2023, by giving proper opportunity to the petitioners / land owners for being heard / to make representation and to award suitable compensation for the land acquired in the
manner known to law, within a time frame.

ORDER
This writ petition has been filed by the petitioner seeking to direct the respondents to commence and complete the land acquisition proceedings for the lands utilized for construction of diversion canal to Adyar river, near the Check Dam, more particularly in Plot Nos.24, 26, 27, 28, 211, 212, 213, 229, 230, 231, 232, 233, 234, 235 and 236, Lakshmi Katatsam Nagar, comprised in Survey Nos.81/2 and 82 of a total extent of 13,306 sq.ft. at No.34, Varadharajapuram Village, Kundrathur Thaluk, Kancheepuram District, pursuant to the administrative sanction granted in G.O.(Ms) No.37 dated 13/06/2023, by giving proper opportunity to the petitioners / land owners for being heard / to make representation and to award suitable compensation for the land acquired in the manner known to law.
2.Mrs.S.Indhu Bala, learned Additional Government Pleader, takes notice on behalf of the respondents. By consent of the parties, the main writ petition is taken up for disposal at the admission stage itself.
3.Learned counsel for the petitioners would submit that the respondents, during the month of November 2020, started constructions work in the petitioners' properties situated at Plot Nos.24, 26, 27, 28, 211, 212, 213, 229, 230, 231, 232, 233, 234, 235 and 236, Lakshmi Katatsam Nagar, comprised in Survey Nos.81/2 and 82 of a total extent of 13,306 sq.ft. at No.34, Varadharajapuram Village, Kundrathur Thaluk, Kancheepuram District, by digging a huge canal to divert the water flow during the said time. However, no acquisition notice was issued by the respondents in this regard. Therefore, the petitioners filed a writ petition in W.P.No.15893 of 2021 and the 1st petitioner alone filed a writ petition in W.P.No.
6840 of 2021 seeking direction to the respondents to initiate proper land acquisition proceedings for the land utilized for the construction of Diversion Cancal to the Adayar River. Considering the same, this Court vide order dated 09.08.2021, directed the 2nd respondent to adhere to the procedure as established by law and inform the petitioners after receiving the administrative sanction and also to put them notice and hear the conduct enquiry and complete the process. Thereafter, after filing contempt Petition Nos.2035 & 2042 of 2022, the respondents circulated G.O.(Ms).No.37 dated 13.06.2023 before this Court, which states the administrative sanction has duly been obtained.

Therefore, the petitioners again issued a legal notice dated 12.05.2025, calling upon the respondents requesting them to proceed further with the acquisition proceedings pertaining to the subject property. Though the respondents are in receipt of the same, there has been no response or action from their end. Hence, the present writ petition has been filed. 4.Learned Additional Government Pleader appearing for the respondents would submit that the representation of the petitioner dated 12.05.2025 will be considered and disposed of at the earliest point of time. 5.
Considering the submissions made by the learned counsel for the petitioner as well as the learned Additional Government Pleader appearing for the respondents and in view of the limited prayer sought for in this writ petition, this Court directs the respondents to consider the representation of the petitioner dated 12.05.2025 on merits and in accordance with law, within a period of eight weeks from the date of receipt of a copy of this order. 6.With the above direction, this writ petition is disposed of. No costs. 7.Post the matter "For Reporting Compliance" on 16.02.2026.
