ORDER

The relief sought for in this writ petition is to call for the records relating to the impugned order passed by the third respondent dated 19.08.2025 in Award No.01/2025-26 in Na.Ka.No.47/2025/A1 and to quash the same, consequently, direct the respondents to pay the additional enhanced compensation under Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and resettlement Act, 2013.

2. Mr.P.Sathish, learned Additional Government Pleader takes notice on behalf of the respondents. By consent of both the parties, this writ petition is taken up for final hearing at the stage of admission itself.

Learned counsel for the petitioner would submit that the properties comprised in S.No.29/3A, situate at Petthakullu Village, Krishnagiri District, measuring an extent of 4 cents was purchased by the petitioner and utilized the same for the purpose of agricultural activities by growing trees, seasonal crops and also dug a well and constructed a motor pump set room. Under these circumstances, the respondents acquired the aforesaid land to an extent of 134 sq.mts for the purpose of establishment of Outer Ring Road for Hosur Town. Since, there exist Trees and Well, the petitioner made a representation dated 31.01.2024 seeking to issue a fair and reasonable compensation for the trees, well and motor pump set room, which are all attached in the acquired land. However, without considering those aspects, the first respondent passed an award in Na.Ka.No.47/2025/A1 by awarding a compensation for the acquired land alone that too a meagre amount of 3/6

Rs.29,268/- only. Challenging the said award, the petitioner has come forward with the present writ petition.

Learned Additional Government Pleader appearing for the respondents would submit that in the present case, the right course available to the petitioner is to challenge the said award by way of filing L.A.O.P., before the District Court. But, without exploring the same, the petitioner has filed the present writ petition.

5. Heard the learned counsel on either side and perused the materials available on record.

In the present case, the grievance of the petitioner is that, at the time of fixation of compensation, the respondents have not taken into consideration the well and trees and passed an award only for an acquired land, which was also very meagre. As rightly submitted by the learned Additional Government Pleader appearing for the respondents, the right course available to the petitioner is to challenge the said award 4/6

by filing L.A.O.P., before the District Court and without doing so, filing this writ petition is not correct. Therefore, this Court is not inclined to entertain the present writ petition and the same is liable to be dismissed. Accordingly, this writ petition stands dismissed and it is open to the petitioner to challenge the aforesaid award in the manner known to law. No costs.
