ORDER

The petitioner, who apprehends arrest at the hands of the respondent police for the offences punishable under Sections 303(2), 326(a) of BNS, 2023 r/w Section 21(1) of the Mines and Minerals (Development and Regulation) Act, 1957 in Crime No. 525 of 2025, on the file of the respondent Police, seeks anticipatory bail.

2. The case of the prosecution is that the petitioner joining hands with 1/4

other accused involved in illegal transportation of 1⁄4 unit of river sand, without any valid license. Hence, the case.

3. The learned counsel for the petitioner submitted that the petitioner is an innocent person and he has been falsely implicated in this case. He further submitted that the petitioner is not the owner of the vehicle. Hence, he prayed to grant anticipatory bail to the petitioner.

4. The learned Government Advocate (Criminal side) for the respondent police, submitted that the petitioner had involved in illegal transportation of 1⁄4 units of river sand and that he has one previous case pending against him. Hence, he opposed to grant anticipatory bail to the petitioners.

5. Considering the facts and circumstances of the case, nature of allegations, and the submissions made by learned counsels on either side, the fact that the petitioner ha one previous case and that the petitioner had allegedly indulged in illegal quarrying activities causing damage to the ecology, this Court is not inclined to grant anticipatory bail to the 2/4

petitioner.
