praying to issue a Writ of Mandamus directing the respondents to properly consider the representations made by the petitioner and duly conduct a fair enquiry in the presence of the petitioner assured before this Court in WP.No.11694 of 2024 and consequently direct them to take appropriate action as against the fourth respondent for violating the service rules and regulations within a time frame fixed by this Court. This writ petition has been filed for direction to respondents to consider the representation submitted by the petitioner to take appropriate action against the fourth respondent as undertaken before the this Court in WP.No.11694 of 2024 darts 29.04.2024. 2.
The petitioner is conducting India Tourist and Industrial 2/6
Fair organized by the respondents in Island Grounds, Chennai with appropriate approval and licence. While being so, the fourth respondent who was being the Manager of Hotel Tamilnadu and Fair incharge, conducted India Tourist and Industrial Fair, 2020. However, he failed to follow any procedures while advertising about the industrial fair in the MTC buses and he committed several irregularities. Therefore, the petitioner submitted representation to take appropriate action against the third respondent and it was not considered. Therefore, writ petition in WP.No.11694 of 2024 was filed before this Court. Before this Court, on the date of hearing, respondents 1 to 3 stated that they will look into the representation submitted by the petitioner. Recording the said submission, the said writ petition was disposed of by an order dated 29.04.2024. Even then, no enquiry was conducted and as such, the petitioner has filed this writ petition.

On instruction, the learned Additional Advocate General submitted that as per the earlier submission made before this Court in WP.No.11694 of 2024, the complaint was enquired and also referred 3/6
before the Vigilance and Anti Corruption Department. After conducting detailed enquiry, the complaint lodged by the petitioner was closed. That apart, the petitioner has no locus to file this writ petition to take appropriate departmental action against the fourth respondent. 4.
Therefore, if at there is all any personal vengeance or any criminality committed by the fourth respondent, the petitioner is at liberty to lodge complaint before the appropriate authority. As such, in order to initiate departmental proceedings, the petitioner has no locus and if at all any irregularity has been committed by the fourth respondent, the superior officers are there to look into the same. In view of the same , this writ petition is dismissed. Consequently, connected miscellaneous petition is closed.
