O R D E R

The petitioner, who apprehends arrest at the hands of the respondent police for the offences punishable under Sections 126, 115(2), 118(1) of BNS in Crime No. 55 of 2025, on the file of the respondent Police, seeks anticipatory bail.

2. The allegation against the petitioner is that on 20.10.2025 at 22.45 hours, when the de-facto complainant was returning home on his two wheeler, the petitioner joining with other accused attacked him with a wooden stick and indiscriminately beat him, rendering him unconscious. Due to the impact, the de-facto complainant sustained injuries on his head, upper limb and swelling on his forehead and fractured. Thereafter, he was witnessed by passersby, who rescued him and admitted him to the hospital. Hence the complaint.

3. The learned counsel for the petitioner submits that the petitioner is an innocent person and he has been falsely implicated in this case. He submits that he has not committed any offence as alleged by the prosecution. He also submits that the petitioner is ready to abide by any conditions that may be imposed by this Court and ready to furnish sufficient solvent sureties for his release. Hence, he prays for grant of anticipatory bail to the petitioner.

4. The learned Government Advocate (Criminal side) for the respondent police, reiterated the prosecution case and submits that the victim grievous injuries and still undergoing treatment. However, he strongly opposed for grant of anticipatory bail to the petitioner.

5. Taking note of the fact that the injured still undergoing treatment in the hospital, hence this Court is not inclined to grant anticipatory bail to the petitioner.
