ORDER

This writ petition has been filed for issuance of a mandamus directing the third respondent to deal with the representation made by the petitioner on 06.10.2024, wherein the petitioner is seeking for cancellation of the patta that has been issued in the names of the impleaded private respondents.

2. Heard the learned counsel appearing on behalf of the petitioner and the learned Government Advocate taking notice on behalf of the respondents 1 to 3.

3. The case of the petitioner is that the subject property was originally classified as 'Gaali Natham' land and it was in possession and enjoyment of the people belonging to the village. An attempt was made to encroach upon the said land and hence a suit came to be filed before the concerned civil Court. However, in spite of the same, the encroachers had managed to get the survey number subdivided and the revenue records were also mutated in their names through the

proceedings of the Tahsildar dated 20.07.2018. Repeated representations were given by the village people seeking for cancellation of the patta that was issued in the names of the private individuals. Since the same was not considered, the present writ petition has been filed.

Taking into consideration the facts and circumstances of the case and the materials placed before this Court, there shall be a direction to the third respondent to deal with the representation made by the petitioner on 06.10.2024 on its own merits and in accordance with law, after giving opportunity to the impleaded private respondents and also after hearing all the interested persons in this case, and final orders shall be passed by the third respondent within a period twelve weeks from the date of receipt of a copy of this order.
