ORDER
This writ petition has been filed challenging the order passed by the first respondent dated 08.10.2024, thereby rejecting the request made by the petitioner seeking promotion to the post of Junior Assistant on par with his juniors.
2. Heard the learned counsel on either side and perused the materials available on record.
3. The petitioner had joined the service of the first respondent as daily wages. His service as Dairy Helper was regularized and placed in the scale of pay and Grade Pay. According to the petitioner, he is senior to the respondents 3 to 5. Therefore, he is entitled to be promoted to the post of Junior Assistant.
4. A perusal of records reveals that the respondents 3 to 5 herein are not juniors to the petitioner. They were promoted to the post of Junior Assistant with effect from 01.09.2018. Whereas, the petitioner is working as Dairy Helper with effect from 01.03.2016 on adhoc basis till date. As per the terms and conditions, regularization in the appointed post would be accorded only pursuant to the approval of the post and cadre strength by the Registrar of Co-operative Societies, Puducherry and specific order will be issued individually. That apart, the promotion cannot be claimed as a matter of right by the employers. Therefore, when the respondents 3 to 5 are not juniors to the petitioner, he cannot ask for promotion on par with his juniors. The request of the petitioner seeking promotion to the post of Junior Assistant would be considered on merit basis when requirements and Rules are approved by the Registrar of Co-operative Societies.
5. Therefore, the request made by the petitioner was rightly rejected and this Court finds no infirmity or illegality in the order passed by the first respondent dated 08.10.2024 and the writ petition is devoid of
merits and is liable to be dismissed.
