2. This Transfer Miscellaneous Petition is filed by the petitioner wife seeking to withdraw HMOP No.79 of 2025 from the file of the Subordinate Court at Nagapattinam and transfer the same to the file of the Sub ordinate Court at Coimbatore.
3. The marriage between the petitioner-wife and the respondent/husband was solemnized on 02.04.2021 at Singara Mahal, Thiruverumpur, Trichy as per the Hindu rites and customs and the marriage was registered at the Thiruverumpur Registrar's Office. It is stated that there are no children out of their wedlock.
4. The respondent husband filed Divorce petition in HMOP.NO. 79/2025 before Subordinate Court at Nagapattinam. The case is at the stage of filing counter.
5. It is the case of the petitioner-wife is that she is residing at Coimbatore along with her parents. It is extremely difficult for her to travel long distance from Coimbatore to Nagapattinam for every hearing, particularly when she cannot travel alone and her aged parents are unable to accompany her.
6. Today, when the matter is taken up for hearing, there is no
representation for the respondent.
7. In transfer petitions arising out of matrimonial proceedings, the convenience of the wife and the hardship likely to be faced by her in attending the proceedings are relevant considerations. The petitioner is residing at Coimbatore and has pleaded dependence on parents and difficulty in undertaking long-distance travel to Nagapattinam on all hearing dates. Having regard to the difficulty pleaded by the petitioner, this Court of the view that ends of justice would be met by allowing this transfer petition.
8. Accordingly, Tr.C.M.P.No.1222 of 2025 is allowed. HMOP No.79 of 2025 on the file of the Subordinate Court at Nagapattinam is withdrawn and transferred to the file of the Sub ordinate Court at Coimbatore. The Subordinate Court at Nagapattinam shall transmit the entire records to the Subordinate Court at Coimbatore within three weeks from the date of receipt of a copy of this order and the Subordinate Court, Coimbatore shall dispose of the matter in accordance with law, as expeditiously as possible, uninfluenced by any observations made in this order. The interim stay granted by this Court on 1211-2025 shall stand vacated and CMP.No.27824 of 2025 is closed. There shall be no order as to costs.
