Respondents Prayer : Writ Petition filed under Article 226 of Constitution of India praying to issue a Writ of Mandamus, forbearing the respondents particularly 1 -4 from interfering and adjudicating the civil dispute by changing the nature of revenue records i.e., Government Grant Patta which stood in the name of petitioner's vendor Mr.Jaffer Ali in Patta No.2208 in respect of property situated S.No.255/6, situated at Saram Village, Tindivanam Taluk, Villupuram District, measuring an extent of 0.53 acres and further to forbear the respondents from conducting any enquiry regarding the cancellation of Government grant patta which stood in the name of petitioner's vendor Mr.Jaffer Ali and pass orders. ORDER

This writ petition has been filed to forbear the respondents 1 to 4 from interfering and changing the revenue records pertaining to the subject property.

2. Heard Mr. G.Mohammed Aseef, learned counsel appearing for the 2/6

petitioner and Mr.D.Ravichander, learned Special Government Pleader appearing on behalf of respondents 1 to 4.

The case of the petitioner is that one Jaffer Ali was the absolute owner of the subject property measuring an extent of 0.53 cents and in this regard, the land ownership certificate was also issued to him by the fourth respondent on 02.10.2011. Thereafter, the petitioner had purchased a portion of 0.24 cents of property from the said Jaffer Ali through a registered sale deed on 28.05.2025. On the same date, he had also purchased another extent of 0.24 cents in the said property and thereby the petitioner is claiming right and title over an extent of 0.48 cents in the subject property. The further case of the petitioner is that the revenue records is also mutated in his name and patta was also issued in his name in Patta No.8122.

4. The fourth respondent issued summons dated 13.01.2021 directing the petitioner to appear before the third respondent for enquiry. The petitioner appeared before the third respondent and submitted all the relevant documents and established his title over the subject property. Despite the same, repeated 3/6

summons were issued to the petitioner, and at one stage, the petitioner found that his title to the property is being questioned. Under such circumstances, the petitioner filed a suit before the Principal Sub Court, Tindivanam in O.S.No.221/2024 seeking for the relief of declaration and permanent injunction. When the suit was pending, desparate attempts were made by the official respondents to change the nature of the property as a Government land. It is under these circumstances, the present writ petition has been filed before this Court.

Taking into consideration the facts and circumstances of the case and the materials placed before this Court, there shall be a direction to the first respondent to deal with the objections made by the petitioner along with all the relevant documents submitted by the petitioner and thereafter, take a decision strictly in accordance with law.

6. This writ petition is disposed of in the above terms. No costs. Consequently, connected miscellaneous petitions are closed. 4/6
