ORDER
This Transfer Civil Miscellaneous Petition is filed under Section 24 of the Code of Civil Procedure, 1908 seeking withdrawal of H.M.O.P. No.435 of 2025 pending on the file of the Family Court, Karur, and transfer of the same to the file of the Subordinate Court, Poonamallee, Tiruvallur District, for disposal in accordance with law.

The case of the petitioner is that the marriage between the petitioner and the respondent was solemnized on 29.08.2022 and out of the wedlock, a male child was born. Due to the matrimonial disputes between the petitioner and the respondent, they started living separately and the respondent has filed H.M.O.P. No.435 of 2025 before the Family Court, Karur seeking dissolution of marriage by a decree of divorce.

The petitioner states that she is residing in Chennai along with her minor child and aged parents and it is stated that the petitioner-wife is taking care of a one-year-old child and would be put to hardship if required to travel frequently from Chennai to Karur and sought for allowing the petition. The pleadings also indicate a substantial distance factor for about 400 kms for every hearing and show that the petitioner has already entered appearance in the H.M.O.P. and the parties were directed to appear before the mediation/counselling centre. 4.
In transfer petitions arising out of matrimonial disputes, the paramount consideration is the ends of justice. Where the wife is required to contest proceedings at a distant place, the Court ordinarily leans in favour of her convenience, particularly when there is no demonstrable prejudice to the other side.

Considering the above circumstances, particularly the residence of the petitioner-wife at Chennai, the responsibility of taking care of a tender-aged child, and the practical difficulty in undertaking repeated long-distance travel, this Court is satisfied that the transfer sought deserves to be ordered. 6.
In the result, Tr.C.M.P. No.1225 of 2025 is allowed. H.M.O.P. No.435 of 2025 pending on the file of the Family Court, Karur is withdrawn and transferred to the file of the Subordinate Court, Poonamallee, Tiruvallur District. The Family Court, Karur shall transmit the entire records in H.M.O.P. No.435 of 2025 to the Subordinate Court, Poonamallee, Tiruvallur District within a period of three weeks from the date of receipt of a copy of this order. On receipt of records, the Subordinate Court, Poonamallee shall dispose of the matter in accordance with law, as expeditiously as possible, uninfluenced by any observations made in this order.
