Prayer : This writ petition has been filed under Article 226 of the Constitution of India, praying to issue a writ of Certiorarified Mandamus, to call for the 1/5
records pertaining to the impugned order vide proceeding Suit No.01/20242025 dated 11.09.2024 passed by the 2nd respondent and quash the same as illegal and consequently directing the respondents to issue for the restoration pleaded jewelry on accept of payment by the petitioner. The petitioner challenges the order passed by the 2nd respondent under Section 90 of the Tamil Nadu Co-operative Societies Act, 1983.
2. Mr.M.Kalai Arasan appearing for Mr.M.S.Elamparithi states that there is no provision of appeal and hence, he has moved this Court by way of the present writ petition.
3. I am afraid of the submission made by the petitioner is legally incorrect. Under Section 152-1(A) of the Tamil Nadu Co-operative Societies Act, 1983 against any decision or award passed under Section 90, an appeal lies to the Co-operative Tribunal cum the Principal District Judge, Coimbatore.
4. Mr.M.S.Elamparithi seeks permission of this Court to prefer an appeal. 2/5
5. Hence the writ petitioner is directed to avail the alternate remedy. In case, an appeal is filed within a period of 30 days from today, the Principal District Judge at Coimbatore shall number the appeal, without insisting upon the application under Section 5 of the Limitation Act. If the appeal is not filed within a period of 30 days the benefit of limitation granted under this order will not ensure in favour of the petitioner.
6. With the above liberty, the writ petition stands dismissed. No costs.
