ORDER
The petitioner, who apprehend arrest at the hands of the respondent police for the alleged offences punishable under Sections 303(2) and 326(a) of BNS, 2023 in Crime No. 301 of 2025, seeks anticipatory bail.
2. The Allegation against the petitioner is that the petitioner joined hands with other accused, illegally quarried sand from the area called Parambai, and while transporting the same, the police intervened and seized the tractor and also the sand.
3. The counsel for the petitioner submitted that the arrested accused has been released on bail and the property has also been recovered. He further submitted that the petitioner is an aged person and has been falsely implicated in this case. Therefore, he prays to grant anticipatory bail to the petitioner.
4. The Government Advocate (Crl.Side) appearing for the respondent police reported that the petitioner is ranked as A1 and he is the owner of the vehicle, and on his instructions only, the sand was transported. Hence, he opposed to grant anticipatory bail to the petitioner.
5. Considering the nature of the offence and also the fact that one unit of sand was seized which was illegally quarried from the water body, I am not inclined to grant anticipatory bail to the petitioner. Accordingly, this criminal original petition is dismissed.
