ORDER

The petitioner, who was arrested and remanded to judicial custody on 28.08.2025, for the alleged offence punishable under Sections 296(b), 109, 118(2) of BNS in Crime No.106 of 2025, on the file of the respondent police, seeks bail.

2. The allegation against this petitioner, that this petitioner is the husband of the defacto complainant and due to quarrel with the defacto complainant he attacked her and caused severe injuries including fracture. Hence, the complaint was registered and the petitioner is arrested.

3. Learned counsel appearing for the petitioner submitted that the petitioner is an innocent person and he has been falsely implicated in this case. He would further submit that the petitioner was arrested and he is in judicial custody from 28.08.2025 and is ready to abide by any conditions that may be imposed by this Court. Hence, he prayed for grant of bail to the petitioner.

4. Learned Government Advocate (Crl.Side) appearing for the respondent police submitted that the injured sustained grievous injuries with fracture and there are six previous cases are pending against the petitioner and he opposed for grant of bail to the petitioner.

5. Heard both sides and perused the materials available on record including the First Information Report.

6. Considering the submissions of the learned counsel on either side, I have also gone through the accident register though it is stated that the petitioner is caused injuries to the victim including fracture and also the fact that the petitioner is having bad antecedents of six previous cases, this Court earlier dismissed bail application on the ground that the victim was not discharged and the petitioner is having six previous cases, though it is stated that injured discharged, this Court is not inclined to grant bail to the petitioner.
