ORDER
The petitioners have filed this petition to suspend the sentence imposed in S.C.No.19 of 2025, on the file of the II Additional District and Sessions Judge, Tiruchengode.
2. The petitioners herein are the accused in S.C.No.19 of 2025, on the file of the II Additional District and Sessions Judge, Tiruchengode. The 6 th and th accused convicted for the offences under Section 109(1) r/w 54 BNSS (3 counts) and under Section 3(1) of the Tamil Nadu Public Property (Prevention of Damage and Loss) Act, 1992 r/w 54 BNSS (3 counts) and sentenced him to undergo 5 years rigorous imprisonment and fine of Rs.3,000/- for each count in default of simple imprisonment for 2 months each count and under Section 3 of the Tamil Nadu Public Property (Prevention of Damage and loss) Act (TNPPDL Act r/w 54 BNS (3 counts) and under Section 3 of the Tamil Nadu public property (Prevention of Damage and loss) Act (TNPPDL Act r/w 54 BNS (3 counts) and sentenced to undergo rigorous imprisonment 3 years and fine of Rs.1,000/- (3 counts) in default of simple imprisonment for 1 month, against which the present revision has been filed.
3. The learned counsel for the petitioners submitted that they have been falsely implicated in this case, and they are ready to abide with any conditions.
4. The learned Government Advocate (Crl.Side) raised strong objections to suspend the sentence.
5. This Court finds no reasons to suspend the sentence, as the Trial Court has gone through the evidence in its entirety, and considering the gravity of the offences, this Court is not inclined to suspend the sentences.
6. Accordingly, this Civil Miscellaneous Petition is dismissed. 18-11-2025
