Prayer: The Writ Petition is filed under Article 226 of Constitution of India, to issue a Writ of Mandamus or any other Writ directing the first respondent to issue permission for road cutting at L.B. Road junction to complete the New Construction of Storm Water Drain of size 1500 mm X 1500 mm at L.B. Road in Division 179, Unit-8, Zone-13 by the respondents 2 and 3 and pass such other orders accordingly.

ORDER

st respondent to The writ petition has been filed seeking a direction to the 1 grant permission for road cutting at L.B. Road junction to complete the new construction of storm water drain of size 1500 mm X 1500 mm at L.B. Road in Division 179, Unit-8, Zone-XIII, by the respondents 2 and 3. 2.It is the case of the petitioner is that Chennai Corporation has issued a work order No.SWDC No.B3/378-27/2025 for demolition and reconstruction of

nd and 3 rd East storm water drain of size 900 mm X 900 mm at Kamaraj Nagar 2 Street and Dr. Muthulakshmi Salai in Division No.179, Zone No.XIII. However, the first respondent /the Deputy Commissioner of Police (Traffic South) has not granted permission to implement the said work. In this regard, the petitioner association has sent representations dated 23.09.2025 and 17.10.2025 to the respondents for providing road cutting permission in order to implement the work as per the Work Order. However, no action has been taken till now. Hence, the petitioner has approached this Court.

3.On instructions, the learned Government Advocate (Crl. Side) would submit that a communication vide Ref. No.Z.O-XIII/C.A/E1/3386/2025, dated 24.09.2025 has been received from the Assistant Engineer, Division-179, ZoneXIII, Greater Chennai Corporation, stating that at present, the proposal for dismantling and reconstruction of storm water drain of Size 1500 mm X 1500 mm at LB Road (From West Avenue to Kamaraj Nagar second East Street) has been modified and the permission for road-cut is not required. Hence, the first respondent is unable to give permission to implement the work. Further, the letter of Corporation/Authority has also been communicated to the petitioner.

4. Recording the aforesaid submissions of the learned Government Advocate (Crl. Side) and communication received from the Assistant Engineer, Zone-XIII, Greater Chennai Corporation, this writ petition (Crl) is closed. 11-11-2025 Lbm Index:Yes/No Speaking/Non-speaking order
