O R D E R

The petitioner, who was arrested and remanded to judicial custody on 14.10.2025, for the offence punishable under Section 123 of BNS, 2023, r/w Section 24(1) of the Cigarettes and Other Tobacco Products Act, 2003, in Crime No.538 of 2025, registered on the file of the respondent, seeks bail. 1/4

2. The case of the prosecution is that this petitioner joining hands with other accused found in possession of 280 kilograms of banned tobacco products. Hence, the complaint.

3. The learned counsel appearing for the petitioner submitted that the petitioner has been in judicial custody since 14.10.2025. He further submitted that two other accused had already been arrested and released on bail by the learned Principal District and Sessions Judge, Chengalpattu, in Crl.M.P.Nos.3303 & 3363 of 2025 dated 28.10.2025. Hence, he prayed for grant of bail to the petitioner.

The learned Government Advocate (Criminal Side) appearing for the respondent while opposing the bail to the petitioner, reiterated the prosecution case and submitted that totally 3 accused in this case, and the petitioner is arrayed as A2. He further submitted that the petitioner has one previous case; and that the investigation of this case is still pending. 2/4

5. Considering the facts, quantity of contraband involved in this case, the previous antecedents of the petitioner and taking note of the fact that the investigation of this case is still pending, this Court is not inclined to grant bail to the petitioner.
