ORDER

The petitioner herein, who was arrested and remanded to judicial custody on 03.10.2025 for the offences punishable under Section 4(1)(A), 4(1)(C) and 4(1-A)(ii) of TNP Amendment Act, 2024 r/w Section 123 of BNS (Section 328 of IPC) in Crime No.119 of 2025, registered on the file of the respondent police, seeks bail.

The case of the prosecution is that, while the respondent police were on routine patrol duty, they found that the petitioner was involved in illegal possession of 50 bottles of Amruts Silver cup brandy (90 ml each). Hence, this case.

The learned counsel appearing for the petitioner submitted that the petitioner has been falsely implicated in this case and he is in judicial custody since 03.10.2025; and that the petitioner is ready to abide by any condition that may be imposed by this Court and sought for bail to the petitioner.

The learned Government Advocate (Crl. Side) appearing for the respondent while opposing the bail to the petitioner reiterated the prosecution case and submitted that the petitioner has four previous cases of similar nature; and that the investigation of the case is pending. 5.

Considering the submissions made on both sides, nature of offence, the previous antecedents of the petitioner, taking note of the fact that the investigation of this case is pending and if the petitioner is enlarged on bail, the petitioner would indulge in similar offence, hence this Court is not inclined to grant bail to the petitioner. 6.

Accordingly, this criminal original petition stands dismissed. 05.11.2025 stn To
