ORDER

The petitioners apprehend arrest for the alleged offence under Sections 303(2), 326(a) of BNS r/w. section 21(5) of Mines and Minerals (Development and Regulation) Act 1957, in Crime No.379 of 2025, on the file of the respondent police seek anticipatory bail.

2. The case of the prosecution is that the petitioners went to the Cheyyar river and illegally quarried one unit of sand from the river by using tractor. Hence the case.

3. The learned counsel for the petitioners submitted that the petitioners are innocent and have not committed the offences alleged by the defacto complainant. He also submitted that the petitioners are ready to abide with any conditions that may be imposed by this Court, and therefore, he prayed to grant

anticipatory bail to the petitioners.

4. The learned Government Advocate (Crl.Side), submitted that a huge quantity of sand has been illegally extracted from the river. Hence, he opposed to grant anticipatory bail to the petitioner. 5 Considering the nature of offence committed by the petitioner, and taking note of the fact that the petitioners are not only involved in quarrying river sand but also in damaging the ecology and the river bed itself, this Court is not inclined to grant anticipatory bail to the petitioners.
