ORDER

The petitioner, who apprehends arrest by the respondent police for the offences punishable under Sections 8(c), 22(b), 25 and 29(1) of NDPS Act, 1985 in Crime No.255 of 2025 seeks anticipatory bail. 2.The case of the prosecution is that the petitioner had supplied 5 grams of Methamphetamine to the arrested accused who are ranked as A1 and A2. Based on secret information, the respondent police recovered 3 grams of methamphetamine from A1 and A2. During the course of investigation, A1 and A2 disclosed that they had obtained the contraband from the petitioner herein. Hence, the complaint. 3.The learned counsel appearing for the petitioner submitted that the petitioner is a college student and he has been falsely implicated in this case. He further submitted that no recovery has been made from the petitioner. Hence, he prayed for grant of anticipatory bail to the petitioner.

4. The learned Government Advocate (Crl.Side) appearing for the respondent police reiterated the prosecution case and submitted that the petitioner is ranked as A3. He further submitted that the petitioner had supplied 5 grams of methamphetamine to the arrested accused and

after the sale of 2 grams of the contraband, the remaining was seized by the respondent police. However, he opposed for grant of anticipatory bail to the petitioner.

5. Heard the learned counsel for the petitioner as well as the learned Government Advocate (Crl.side) and perused the materials available on record.

6. Considering the submissions made by the learned counsel on either side, though the contraband seized was not a commercial quantity, at this stage, if the petitioner is released on anticipatory bail, there is every likelihood of his indulge in similar activities. Therefore, this Court is not inclined to grant anticipatory bail to the petitioner.

7. Accordingly, this Criminal Original Petition is dismissed. 06-11-2025 drl
