ORDER

The petitioners, who were arrested and remanded to judicial custody on 28.09.2025, for the alleged offence punishable under Section 306 of BNS, 2023, in Crime No.362 of 2025, on the file of the respondent police, seeks bail.

2. The allegation against these petitioners is that, these petitioners while working in the jewellery shop of the defacto complainant, they have stolen the golden jewels to the extent of 1200 grams, which is nearly worth about Rs.75,00,000/-. Hence this case.

3. Learned counsel appearing for the petitioners submitted that the petitioners are an innocent person and they have been falsely implicated in this case. He would further submit that the petitioners were arrested and in judicial custody from 28.09.2025 and ready to abide by any conditions that may be imposed by this Court. Hence, he prayed for grant of bail to the petitioners.

Learned Government Advocate (Crl.Side) appearing for the respondent police reiterated the prosecution's case and submitted that the petitioners, employees of the defacto complainant shop in collusion with other accused committed theft of gold jewels and handed over the same to other accused. Totally 1200 grams of gold jewels were stolen by the accused, only 12 grams gold, two phones and one car were recovered, balance gold is yet to be 2/4

recovered, investigation in this case is still pending. Hence, he strongly opposed for grant of bail to the petitioners.

5. Heard both sides and perused the materials available on record including the First Information Report.

Considering the submissions of the learned counsel on either side, and perused the records, it reveals that the petitioner has been employed during the period misappropriation, and that gold valued at approximately Rs.75,00,000/- remains not recovered by the police, and investigation is pending, if the petitioners granted bail, it will hamper the investigation, and the petitioners is this Court is not inclined to grant bail to the petitioners at this stage.
