No.10 of 2022 on the file of the 1st respondent, in compliance of the order of 2nd respondent in his proceedings in Na.Ka.No. 31566 / 2021 / A3 dated 15.09.2021.

ORDER
Heard Mr.Selvaraju, learned counsel for the petitioner and Mr.S.Ravichandran, learned Additional Government Pleader appearing for the respondents.

The petitioner seeks issuance of writ of Mandamus to direct the 3rd respondent fit person already appointed for the subject Temple i.e., Arulmigu Thambiraatiyamman Thirukoil to take control of the administration of the said temple and its properties temporarily till disposal of the scheme application in O.A.No.10 of 2022, on the file of the 1st respondent.

The case of the petitioner is that the 2nd respondent has already passed an order as early as on 15.09.2021 appointing a fit person for the said Temple and subsequent orders have been passed on 20.12.2023 on the same lines. The grievance of the petitioner is that certain miscreants in the locality are creating ruckus and ugly situation, which is permitting a peaceful atmosphere for the devotees to worship. It is in this regard, the petitioner has filed an application for 2/5
framing a scheme and the same is admittedly pending on the file of the 1st respondent. Pending scheme in O.A.No.10 of 2022, respondent have already appointed the 3rd respondent Executive Officer of Sellandiyamman Thirukoil, as fit person for the subject temple.

The petitioner is only seeking for a limited prayer, i.e., the fit person so appointed by the respondents to take control of the administration of the Temple and its properties in order to ensure peace prevails and there are no untoward incidents in the temple premises and there is a conducive atmosphere for peaceful worship by the devotees. Presently, the writ petitioner is holding the charge of the administration of the Temple and he is also willing to handover charge to the fit person.

In view of the above, pending disposal of the scheme application in O.A.No.10 of 2022, there shall be a direction to the 3rd respondent to take control of the administration of the Temple and its properties from the writ petitioner. If necessary, the respondents shall take assistance of the local police officials to ensure that there is no breach of law and order in the locality and such exercise shall be carried out within a period of two weeks from the date of receipt of a copy of this order. The scheme application shall be disposed of by the 1st 3/5
respondent within a period of three months from the date of receipt of a copy of this order.
