ORDER

The petitioner, who apprehends arrest at the hands of the respondent police for the offences punishable under Sections 303(2), 326(a) of BNS r/w Sections 21(5) of Mines & Minerals (Development & Regulation) Act, in Crime No. 191 of 2025, seeks anticipatory bail. 1/4

2. The case of the prosecution is that based on the secret information, the respondent police went to the scene of occurrence and found that the petitioner was found in illegal possession of 1⁄4 unit of river sand with the help of Bullock cart. Hence, the case.

3. The learned counsel for the petitioner submitted that the petitioner is an innocent person and he has been falsely implicated in this case. He further submitted that he is ready to abide by any conditions that may be imposed by this Court. Hence, he prayed to grant anticipatory bail to the petitioner.

The learned Government Advocate (Criminal side) for the respondent police, submitted that the petitioner had involved in illegal possession of 1/4 unit of river sand and that the petitioner has no previous cases pending against him. Hence, he opposed to grant anticipatory bail to the petitioners.

5. Considering the nature of allegations, the submissions made by 2/4

learned counsels on either side, nature of allegations and also considering the fact that the petitioner is not only illegally quarried river sand but also caused damage to the ecology and river bed, this Court is not inclined to grant anticipatory bail to the petitioner.
