ORDER

The petitioner, who was arrested and remanded to judicial custody on 09.10.2025, for the alleged offence punishable under Sections 309(4), 3(5) of BNS, in Crime No.395 of 2025, on the file of the respondent police, seeks bail.

2. The allegation against this petitioner is that, this petitioner is ranked as A1 in this case and he along with other accused waylaid the defacto complainant and with the knife point robbed a sum of Rs.400/- and also cell phone. Hence the complaint.

3. Learned counsel appearing for the petitioner submitted that the petitioner is an innocent person and he has been falsely implicated in this case. He further submitted that already co-accused was released on bail. He would further submit that the petitioner was arrested and he is in judicial custody from 09.10.2025 and is ready to abide by any conditions that may be imposed by this Court. Hence, he prayed for grant of bail to the petitioner.

4. Learned Government Advocate (Crl.Side) appearing for the respondent police reiterated the prosecution's case and submitted that the petitioner is 2/4

having four previous cases all are similar in nature, investigation is not completed, and opposed for grant of bail to the petitioner.

5. Heard both sides and perused the materials available on record including the First Information Report.

6. Considering the submissions of the learned counsel on either side, the petitioner is not having any bad antecedents but involved in the case of report with the knife point and also investigation in this case is not completed, he is having four previous cases, and if the petitioner is granted bail at this stage he will indulge in similar activities, this Court is not inclined to grant bail to the petitioner.
