ORDER

This writ petition has been filed for the issue of writ of Mandamus directing the respondents to consider the representation made by the petitioner on 25.08.2025 wherein the petitioner has sought for issuance of patta in his name with respect to the subject property.

When the matter was taken up for hearing on 19.11.2025, this Court passed the following order:-

Mr.C.Jayaprakash, learned Government Advocate, takes notice for respondents 1 to 3 & 5.

2. Mr.V..Sudalaiselvan, learned Standing Counsel, takes notice for fourth respondent.

3. Considering the fact that the Tahsildar has already passed an order on 18.08.2020 directing issuance of patta in the name of the petitioner and others and considering the report that has already been submitted by Village Administrative Officer and the Revenue Inspector, the only thing to be ascertained by learned Standing Counsel for CMDA is as to whether the subject property falls within the ownership of CMDA.

Post this writ petition on 24.11.2025.

Pursuant to the above order, the matter was listed for hearing today. The learned Standing counsel appearing on behalf of the CMDA submitted that acquisition proceedings were initiated and compensation was also paid and CMDA is in the process of ascertaining whether the subject property also continues to be owned by the CMDA.

In the considered view of this Court, a detailed enquiry has already been conducted by the Tahsildar and an order has been passed on 18.08.2020 after considering the report submitted by the Village Administrative Officer and the Revenue Inspector. A recommendation has been made to transfer the patta in the name of the petitioner and others. Such an order was passed only after ascertaining the fact that the subject property does not belong to CMDA and now CMDA cannot come and take a different stand before this Court since the report was submitted and the order was passed by the revenue officials.

In view of the above, there shall be a direction to the 3rd respondent to pass consequential orders on the representation made by the petitioner on 25.08.2025 and transfer the patta in the name of the petitioner and others in line with the earlier order passed on 18.08.2020. This process shall be completed within a period of four weeks from the date of receipt of a copy of this order. 6.

This writ petition is disposed of with the above directions. No costs.
