ORDER

This writ petition has been filed for the issue of writ of mandamus forbearing the 1st and 2nd respondents from issuing any patta with respect to the subject property in favour of the 3rd respondent, since the suit is pending between the parties in O.S. No.172/2022, on the file of the Principal Sub Judge, Mettur.

2.Heard Mr.M.R.Jothimanian, learned counsel appearing on behalf of the petitioner and Mr.C.Jayaprakash, learned Government Advocate appearing on behalf of respondents 1 and 2.

3/5 3.In the considered view of this court, if any application has been filed by the 3rd respondent seeking for issuance of patta and a suit is pending between the parties, obviously, the concerned Tahsildar will issue notice to the rival parties and take into consideration the fact that a suit is pending between the parties. Since the petitioner has already submitted an objection on 26.05.2025 in this regard, as and when any such application is received, such objection has to be considered before a final decision is taken. This clarity will sufficiently take care of the grievance expressed by the petitioner. 4.This writ petition is disposed of in the above terms. No Costs.
