ORDER

The petitioner, who was arrested and remanded to judicial custody on 04.10.2025, for the alleged offence punishable under Sections 132, 296(b), 324(3), 351(3) of BNS (u/s.353, 294(b), 426, 506(ii) of IPC), in Crime No.421 of 2025, on the file of the respondent police, seeks bail.

2. The allegation against this petitioner is that, this petitioner while the Police Officials were in official duty on the Pondicherry, they intercepted the vehicle of this petitioner along with 3 other accused persons and they created ruckus and also started quarrel and abuse the officials in filthy language. Further when they were taken for custody, they damaged the CCTV in the area and damages estimated at Rs.10,000/-. Hence this case.

3. Learned counsel appearing for the petitioner submitted that the petitioner is an innocent person and he has been falsely implicated in this case. He would further submit that the petitioner was arrested and in judicial custody from 02.10.2025 and ready to abide by any conditions that may be imposed by this Court. He further submitted that already the co-accused 2 to 4 were released on bail and as per this petitioner is concerned the bail was dismissed on the ground that the petitioner is having previous cases, in the earlier order reported that the petitioner is having only two previous cases. Hence, he prayed for grant 2/6

of bail to the petitioner.

Learned Government Advocate (Crl.Side) appearing for the respondent police reiterated the prosecution's case and submitted that this petitioner is having 15 previous cases and the petitioner is ranked as A1 and investigation is not completed. He also produce the statement showing the list of previous cases where the petitioner has involved are as follows: 3/6

Hence, he strongly opposed for grant of bail to the petitioner.

5. Heard both sides and perused the materials available on record including the First Information Report.

6. Considering the submissions of the learned counsel on either side, that the petitioner is having 15 previous cases and the petitioner is ranked as A1 and investigation is not completed in this case, this Court is not inclined to grant bail to the petitioner.
