Writ Petition filed under Article 226 of the Constitution of India praying to issue a Writ of Mandamus, directing the 1st respondent to process the petitioners application dated 26.11.2024 filed under section 28A of the Land Acquisition Act 1894 seeking for re determination of compensation in respect of the petitioners acquired land, in accordance with the Judgement dated 4.9.2024 passed by the Honble special Sub court for L.A.O.P cases, Tiruvallur in L.A.O.P.No.157 of 2023 within such time frame directing the 1st respondent to process the petitioners application dated 24.04.2024 filed under section 28A of the Land Acquisition Act 1894 seeking for re determination of compensation in respect of the petitioners acquired land, in accordance with the Judgement dated 29.1.2024 passed by the Honble special Sub court for L.A.O.
P cases, Tiruvallur in L.A.O.P.No.267 of 2023 within such time frame directing the 1st respondent to process the petitioners application dated 26.11.2024 filed under section 28A of the Land Acquisition Act 1894 seeking for re determination of compensation in respect of the petitioners acquired land, in accordance with the Judgement dated 29.1.2024 passed by the Honble special Sub court for L.A.O.P cases, Tiruvallur in L.A.O.P.No.
For Petitioner in all petitions : Mr.K.Nagarajan For Respondent in all petitions : Mr.P.Sathish, AGP for R1 to 3 Mr.V.Sudalai Selvan, St.counsel for R4 COMMON ORDER These writ petitions have been filed to direct the 1st respondent to process the petitioners' application filed under Section 28A of the Land Acquisition Act, 1894, seeking for re-determination of compensation in respect of the petitioners' acquired lands.
2. Mr.P.Sathish, learned Additional Government Pleader, takes notice on behalf of the respondents 1 to 3. Mr.V.Sudalai Selvan, learned Standing counsel, takes notice on behalf of the 4th respondent.
3. By consent of the parties, the main writ petitions have been taken up for disposal in the admission stage itself. 3/8
4. The learned counsel for the petitioners would submit that in these cases, the petitioners are the absolute owners of the respective subject lands. The subject lands were acquired for Outer Ring Road Scheme under Section 4(1) vide Notification dated 21.03.2006. Thereafter, 3rd respondent passed an award fixing the compensation at Rs.1,000/- per cent. Under these circumstances, the petitioners came to know that similarly placed land owners had sought reference under Section 18, whereby, the compensation was enhanced to a sum of Rs.50,000/- per cent vide judgement dated 04.09.2024 passed in LAOP.No.157 of 2023. Hence, the petitioners had filed the applications under Section 28A for re-determination of compensation. However, the same was not considered by the respondents till date. Hence, these petitions.
5. In reply, the learned Additional Government Pleader appearing for the respondents would submit that the applications filed by the petitioners will be considered within a period of 4 weeks. 4/8
6. Heard the learned counsel for the petitioner and the learned Additional Government Pleader appearing for the respondents and also perused the entire materials available on record.
7. In the cases on hand, the petitioners are the sole and absolute owners of the respective subject lands, which were acquired for Outer Ring Road Scheme under Section 4(1) vide Notification dated 21.03.2006. Subsequently, the 3rd respondent passed an award fixing the compensation at Rs.1,000/- per cent. Under these circumstances, the petitioners came to know that similarly placed land owners had sought reference under Section 18, whereby, the compensation was enhanced to a sum of Rs.50,000/- per cent vide judgement dated 04.09.2024 passed in LAOP.No.157 of 2023 and hence, the petitioners had filed the applications under Section 28A for re-determination of compensation. 8. In view of the above, the 1st respondent is directed to consider the petitioners' applications dated 26.11.2024, 24.04.2024 & 26.11.2024, within a period of 4 weeks from the date of receipt of a copy of this order.
9. With the above directions, these writ petitions are disposed of. No cost.
