Habeas Corpus Petition filed under Article 226 of the Constitution of India to issue a Writ of Habeas Corpus directing the respondents 1 and 2/police to produce the body or person of the petitioner's minor daughter Sangavi, aged about 16 years, who is under the illegal custody of the third respondent, before this Court and handover to the petitioner. ORDER

(made by N.Sathish Kumar, J.) This habeas corpus petition has been filed seeking a direction to produce the petitioner's daughter Sangavi, aged about 16 years, from the illegal custody of the third respondent, before this Court and handover to the petitioner.

It is the case of the petitioner that her daughter Sangavi, aged about 16 years, who is studying XI standard, went missing from 22.10.2025

and she is in the illegal custody of the third respondent herein; in this regard, she has lodged a complaint before the second respondent/police on 22.10.2025, pursuant to which, an FIR in Crime No.400 of 2025 has been registered; however, the police are not taking effective steps to secure her daughter and hence, she has preferred the present habeas corpus petition. 3.

On instructions, the learned Additional Public Prosecutor submitted that the detenue Sangavi has been secured on 07.11.2025 and handed over to the Kasturiba Niketan Children Home, Rajannagar, Erode - 638451, Sathyamangalam and she has been produced before this Court today.

When the detenue Sangavi was enquired by us, she said that she has voluntarily left the house with the third respondent and now she is willing to go with her mother/petitioner herein, who is also present before this Court. The petitioner is also ready to take the detenue. Therefore, the detenue Sangavi is permitted to go with her mother, petitioner herein.

In view of the above, this habeas corpus petition stands closed. (N.S.K., J.) (M.J.R., J.) 24.11.2025 nsd
