O R D E R

The petitioner, who was arrested and remanded to judicial custody on 27.09.2025 for the alleged offence under Sections 275, 123 of BNS 2023 and Section 7(1), 20(2) of Cigarette and Other Tobacco Act, 2003 in Crime No.992 of 2025 on the file of the respondent police, seeks bail. 1/4

2. The case of the prosecution is that the petitioner, along with other accused persons, was found in possession of 537.8 kgs of banned tobacco products. Hence, the case.

3. The learned counsel for the petitioner submitted that the petitioner is innocent and has been falsely implicated in this case. He further submitted that the petitioner has been in custody from 27.09.2025 and that he is ready to abide by any stringent conditions that may be imposed by this Court. Hence, he prays for grant of bail to the petitioner.

The learned Government Advocate (Criminal Side) appearing for the respondent police reiterated the prosecution case and, on instructions, submitted that the petitioner's earlier bail petition was dismissed by this Court vide order dated 15.10.2025 in Crl.O.P.No.28188 of 2025. He further submitted that the present petition has been filed without any change in circumstances after the dismissal of the earlier bail petition. He also submitted that the petitioner belongs to the State of Odisha and that, if he is enlarged on bail, there is every possibility of absconding, making it difficult to secure his presence. Hence, he vehemently opposed the grant of bail to the petitioner.

5. Heard both sides and perused the materials available on record.

6. Considering the nature and gravity of the offence and the fact that the present petition has been filed without any change of circumstances after dismissal of the earlier bail petition, this Court is not inclined to grant bail to the petitioner.

7. Accordingly, this Criminal Original Petition stands dismissed. 12.11.2025 Vv 3/4
