O R D E R
The petitioner, who was arrested and remanded to Judicial custody from 09.10.2025 for the offences punishable under Section 24(1) of COTP Act and under Section 123 of BNS in Crime No.439 of 2025 on the file of the respondent police, seek bail.
2. The case of the prosecution is that this petitioner indulged in the illegal sale of banned tobacco products and during search conducted by the respondent police, the petitioner was found in possession of 15 kg 440 grams of banned tobacco products. The petitioner was arrested and the banned tobacco products and two wheeler were seized. Hence the case.
3. The learned counsel for the petitioner would submit that the petitioner is an innocent person and he has been falsely implicated in this case. The petitioner is in custody from 09.10.2025. Hence, he prays for granting bail.
4. The learned Government Advocate (Crl.side) would submit that the petitioner was found in possession of 15 kg 440 grams of banned tobacco products. The petitioner was arrested and the banned tobacco products and two wheeler seized. He would further submit that the petitioner is having one previous case of similar nature. Hence, he objects granting bail.
5. Considering the nature of offence, the recovery of huge quantity of banned tobacco products, the bad antecedent of the petitioner, this Court is not inclined to grant bail to the petitioner.
6. Hence, the petition is dismissed.
