The petitioner seeks a direction to the 1st respondent to pass orders on the petitioner's representation, dated 30.08.2025, not to issue No Objection Certificate, if any document is presented for the property situated at Pappankuzhi Village, Sriperumbudur Taluk, Kancheepuram, through a forgery sale deed dated 18.11.2008 registered as Document No.8743/2008 on the file of the SRO, Walajabad.

2.It is the case of the petitioner that the petitioner's father originally owned the properties in Survey Nos.190/1, 195/2, 195/3, 293/2, 295/1A, 294, 295/1D, 295/1C, 295/C, measuring a total extent of 2 Acres 69 Cents, situated at Pappankuzhi Village, Sriperumbudur Taluk, Kancheepuram District. The petitioner's father died on 15.04.2023. After the death of his father, the petitioner came to know that one Shivakumar @ J.K.Rithish, Son of A.Kulandaivelu, has created a forged Power of Attorney allegedly executed by the petitioner's father, by impersonating the petitioner's father,

and has registered the same on 09.09.2008. Pursuant to the forged Power of Attorney, a sale deed came to be executed on 18.11.2008 in the name of M/s.KEN BUILDCON Private Limited which was also registered as Document No.8743 of 2008 on the file of the SRO, Walajabad. On coming to know of these facts, the petitioner filed a civil suit in O.S.No.240 of 2024 before the District Munsif Court, Sriperumbudur, to declare the sale deed, dated 18.11.2008, bearing Doc.No.8743 of 2008, as null and void. It is the contention of the petitioner that the properties are wet lands and it cannot be used for any other purpose other than agriculture. However, now, the petitioner came to know that the land grabbers are trying to get a No Objection Certificate from the 1st respondent for non-agricultural activities.

Hence, the petitioner gave a representation on 30.08.2025 to the 1st respondent not to issue No Objection Certificate to the land grabbers. Since no action is forthcoming, the petitioner has filed the present writ petition. 3.Learned counsel for the petitioner would submit that the petitioner is in possession of the properties all these years and now, the land grabbers are trying to get NOC from the 1st respondent/District Collector and take possession of the properties. Hence, he seeks a direction.

4.Mr.Stalin Abhimanyu, learned Additional Government Pleader, takes notice for the 1st respondent.

5.I have perused the entire materials available on record. 6.Admittedly, the petitioner has already filed a civil suit to annul the sale deed said to have been executed by forgery. Besides, it is also stated that a criminal case is also pending against third parties in Crime No.154 of 2011 on the file of Anti Land Grabbing Special Cell, Kancheepuram District. The suit filed by the petitioner appears to be still pending before the Civil Court. If at all any threat is posed, it is for the petitioner to file necessary application before the Civil Court where the suit is pending and seek appropriate relief. If any such application is filed, the Civil Court shall dispose of the same on its own merits as expeditiously as possible. 7.With the above directions, this writ petition is disposed of. No costs.
