ORDER
The petitioner herein, who was arrested and remanded to judicial custody on 21.08.2025 for the offences punishable under Section 123 of BNS and Section 24(1) of Cigarette and Other Tobacco Products Act, 2003 in Crime No.358 of 2025, seeks bail. The earlier bail application of the petitioner was dismissed by this Court, vide order dated 07.10.2025 in Crl.O.P.No.27499 of 2025 for the following reasons. "2. Earlier bail application was dismissed by this Court in Crl.O.P.No.25076 of 2025 dated 12.09.2025 and there is no change in circumstances after the dismissal of the earlier bail petition."

The learned counsel for the petitioner submitted that the petitioner has been falsely implicated in this case and he is in judicial custody since 21.08.2025; and that the petitioner is ready to abide by any stringent conditions that may be imposed by this Court, hence sought for bail to the petitioner.

The learned Government Advocate (Crl. Side) appearing for the respondent while opposing the bail to the petitioner submitted that the total quantity of tobacco products involved in this case is 350 kilograms, which is 2/4
seized from the petitioner's house; that the petitioner has three previous cases of similar nature; and that the investigation of the case is still pending. 4.
Considering the facts of the case, the quantity of contraband involved, the previous antecedents of the petitioner, taking note of the fact that the investigation of the case is still pending and there is no change of circumstances after the dismissal of the earlier bail application of the petitioner in Crl.O.P.No.27499 of 2025, this Court is not inclined to grant bail to the petitioner.
