O R D E R

The petitioner, who was arrested and remanded to judicial custody on 15.10.2025, for the offence punishable under Sections 316(2) and 318(4) of BNS, 2023 in Crime No.739 of 2025, registered on the file of the respondent, seeks bail.

2. The allegation against the petitioner is that the petitioner was 1/4

employed with the complainant's whole sale business and was entrusted with handling financial transactions and company funds in the ordinary course of business. Petitioner herein colluded with other accused misappropriated the funds of the company to the tune of approximately Rs.24,00,000/- and they diverted the said amount to their personal gain without any authorization or accounting. Hence, the case.

The learned counsel appearing for the petitioner submitted that the petitioner is the one who unearthed the misappropriation committed by other accused and the petitioner was also participated in the enquiry and also assisted the defacto complainant in this regard. He further submitted that the petitioner is in custody and he requires treatment and his presence is required for the treatment of his child. Hence, he prayed for grant of bail to the petitioner.

4. The learned Government Advocate (Crl. Side) reiterated the prosecution case and submitted that the investigation in this case is pending.

5. Considering the fact that the huge amount has been 2/4

misappropriated by the accused and no money has been recovered and other accused has not been secured, this Court is not inclined to grant bail to the petitioner.
