O R D E R

The petitioner, who apprehends arrest by the respondent police for the offence punishable under Section 318(4) of BNS Act, 2023 r/w 15(3) of Indian Medical Council Act, 1956 in Crime No.724 of 2025 seeks anticipatory bail.

2.The allegation against the petitioner is that, despite having 1/4

studied only upto the 10th standard, the petitioner was allegedly involved in Allopathy treatment by fixing the board as an MBBS Doctor. Hence, the complaint.

3.The learned counsel appearing for the petitioner submitted that the petitioner is a qualified Ayurveda practitioner and has also obtained certain certificates in this regard. He further submitted that he is entitled to practice and has produced relevant documents in support of his claim. Hence, he prayed for grant of anticipatory bail to the petitioner.

4. The learned Government Advocate (Crl.Side) appearing for the respondent police reiterated the prosecution case and submitted that the petitioner was involved in treating persons without any qualification or registration. However, he opposed for grant of anticipatory bail to the petitioner.

5. Heard the learned counsel for the petitioner as well as the learned Government Advocate (Crl.side) and perused the materials available on record.

On perusal of the documents produced by the petitioner, it is seen that some of the certificates revealed that the petitioner had completed Master of Science in Counselling and Psychotherapy, Diploma in Community Medical Service and Essential Drugs and he is a member of the Indian Natural Therapy Council. However, the petitioner is neither an authorized nor a registered medical practitioner under Ayurveda nor under the Medical Council and claiming himself to be an Ayurveda Doctor is misconceived.

7. In view of the above, this Court is not inclined to grant anticipatory bail to the petitioner.
