ORDER

The petitioners, who apprehend arrest at the hands of the respondent police for the alleged offences punishable under Section 303 of BNS, 2023 in Crime No. 445 of 2025, seeks anticipatory bail.

2. The allegation against the petitioners is that both petitioners have illegally taken away sand from the lake situated in Nariyanahali village, and when the police party intercepted, the first petitioner stopped the vehicle and ran away from there. Hence, the case.

3. The learned counsel for the petitioners submitted that the petitioners have a license to take the sand from the lake and the complaint has been falsely given, and he prays to grant bail.

4. He also relied on proceedings initiated by the Tahsildar Kariyamanglam. However, on perusal of the certificate issued, it reveals that the license to quarry the sand was given in favour of one Tmt. Meena. It appears that the petitioners are attempting to justify the illegal quarrying and

transportation since the petitioners involved in illegal quarry of sand and damaged the waterbody, I am not inclined to grant anticipatory bail to the petitioners.
