ORDER

The petitioner, who apprehend arrest at the hands of the respondent police for the alleged offences punishable under Sections 274, 275, and 123 of BNS read with section 24(1) of Cigarette and other Tobacco Products Act, 2003 in Crime No. 498 of 2025, seeks anticipatory bail.

2. The case of the prosecution is that the petitioner was in illegal possession of 10,985 pouches weighing 53 kgs of banned Tobacco products. Hence, the complaint.

3. The learned counsel for the petitioner would submit that the petitioner is not having any previous case and has been falsely implicated in this case. Therefore, he prays to grant anticipatory bail to the petitioner.

4. The learned Government Advocate (Crl.Side) would submit that he petitioner was illegally found in possession of 53 kgs of banned tobacco products. He further submitted that there are no previous cases pending against

the petitioner. However, he opposed to grant anticipatory bail to the petitioner.

5. Considering the fact that the quantity involved in this case is high, though it is reported that the petitioner is not having any previous case, I am not inclined to grant anticipatory bail to the petitioner. Accordingly, this Criminal Original Petition is dismissed.
