The petitioner, who apprehends arrest at the hands of the respondent police for the offences punishable under Sections 417, 420 of IPC and 1/6

Section 4 of the Dowry Prohibition Act, 1961 in C.C.No. 182 of 2023, on the file of the respondent Police, seeks anticipatory bail. 2.The allegation against the petitioner is that the petitioner met the defacto complainant through "Tamil Matrimony.Com" and shared their harascopes, thereafter, they entered into good relationship, in which, he had physical relationship with her under the guise of false promise to marry her and subsequently, he went to Dubai without marrying her and never to return back to India. Hence the complaint.

3.The learned Counsel for the petitioner submits that the petitioner has not committed any offence as alleged by the prosecution and he has been falsely implicated in this case. He further submits that on 02.11.2021, the de-facto complainant gave a complaint in CSR.No. 539 of 2021 with the respondent police against the petitioner and he attended the enquiry and 2/6

closed the matter as mistake of fact. However, the petitioner is ready to abide any condition imposed by this Court and ready to co-operate for enquiry. He prays for grant of anticipatory bail to the petitioner. 4.Mr.A.Gopinath, learned Government Advocate [Criminal Side] appearing for the respondent police, reiterated the case of the prosecution and submits that the petitioner still in Abroad. He further submits that final report has filed and absconding charge sheet has also been filed. He further submits that NBW has been issued against the petitioner in C.C.No. 182 of 2023. He opposed for grant of anticipatory bail to the petitioner. 5.Considering the facts and circumstances of the case and the submissions made by the learned Counsel on either side; that the gravity of offence committed by the petitioner; that the petitioner has not mentioned any particular date when he will return back to India; this Court is not inclined to grant anticipatory bail to the petitioner. 3/6
