ORDER

The petitioners, who apprehends arrest for the alleged offence punishable under Sections 21(1) &21(4) of MM Act and Section 303(2) of BNS Act, in Crime No.461 of 2025 on the file of the respondent police, seeks anticipatory bail.

2. The allegation against these petitioners is that, these petitioners are involved illegally quarrying and transporting 6 units of gravel sand by using 2 lorries and after seeing the officials these petitioners stopped the vehicle and ran away from there. Hence properties were recovered.

3. The learned counsel appearing for petitioners submitted that the petitioners have not committed any offence as alleged by the prosecution, and they have been falsely implicated in this case. He further submitted that the petitioners are only drivers. Hence, he prays for grant of anticipatory bail.

4. The learned Government Advocate (Crl. Side) appearing for respondent would submit that totally 4 accused in this case, petitioners are ranked as A1 and A2 and investigation in this case is pending and huge quantity 2/4

of gravel sand have been illegally quarried and source of quarry is also yet to be ascertained. Hence, he opposed to grant anticipatory bail to the petitioners.

Considering the facts and circumstances of this case, these petitioners are quarrying 6 units of gravel sand in the 2 lorry and investigation in this case is pending and if the petitioners are granted anticipatory bail they will indulge in similar activities, and this Court is not inclined to grant anticipatory bail to the petitioners with certain conditions.
