ORDER

The present application has been taken out for impleading the petitioner as proposed respondent in the first appeal.

2. Heard Mr.G.Nanmaran, learned Special Government Pleader for the appellant and Mr.I.Abdul Basith, learned counsel for the first respondent.

The case of the petitioner is that based on a complaint lodged by the appellant, regarding the agreement in Ex.B11, an enquiry is being conducted and this Court on the criminal side has issued directions, by order dated 28.01.2025, in CRL O.P.No.31532 of 2024. According to the learned Special Government Pleader, subsequent to the said order, the impleading petitioner has taken appropriate steps and has conducted, detail enquiry. On going through the affidavit, I find that purpose of seeking impleadment is only to seek custody of Ex.B11, the original lease agreement which is typed on stamp paper in AD 785815, for the purpose of obtaining a report from the Tamil Nadu Forensic Science Department.

4. In view of the above, I do not see why the petitioner should be impleaded for such limited purpose. In fact in paragraph Nos. 8 and 9, the impleading petitioner has clearly specified the purpose for which their application has taken out. The 1st Respondent can have no objection if the document is sent to the Forensic Science Department for examination, since the enquiry itself has been taken up, at his instance.

5. There was no representation for the defendant/respondent in the first appeal and even today. In fact appeal suit was heard in the absence of the contesting defendant/respondent herein.

6. In the light of the above, this petition is partly allowed in the manner following:- (i) The request for impleading is dismissed.

(ii) This Court directs the Registry to hand over Ex.B11 in a sealed cover, addressed to a Tamil Nadu Forensic Science Department and hand over the same to the Special Government Pleader/Investigating officer of Cr.No.5 of 2025, for the purpose of obtaining a report from the Tamil Nadu Forensic Science Department and on completion of the examination by the Tamil Nadu Forensic Science Department, the original of Ex.B11 shall be returned in a sealed cover to the Registry of this Court, to be put up in the records along with AS.No.162 of 2023. dsn 15-12-2025 (1/2) Index:Yes/No Speaking/Non-speaking order Internet:Yes 3/5
