ORDER

The petitioner herein, who was arrested and remanded to judicial custody on 01.10.2025 for the offences punishable under Section 4(1)(C), 5(A) of TNP Act r/w 77 of JJ Act in Crime No.914 of 2024, registered on the file of the respondent police, seeks bail. 2.

The case of the prosecution is that the petitioner/ A1 is the employee under A2, who is running a restaurant; that while the respondent police conducted a search in the A2's restaurant, they found that the accused were involved in illegal possession of 53 numbers of TASMAC liquor bottles for the purpose of selling the same to the general public without any valid permit. Hence, this case.

The learned counsel appearing for the petitioner submitted that the petitioner has been falsely implicated in this case and he has not committed any offence; that he is in judicial custody since 01.10.2025; and that the petitioner is ready to abide by any condition that may be imposed by this Court and sought for bail to the petitioner. 2/4

The learned Government Advocate (Crl. Side) appearing for the respondent while opposing the bail to the petitioner reiterated the prosecution case and submitted that there are totally two accused involved in this case and the petitioner is arrayed as A1; that the petitioner has 16 previous cases of similar nature; and that the investigation of the case is pending.

Considering the submissions made on both sides, nature of offence, the previous antecedents of the petitioner and taking note of the fact that the investigation of this case is pending, this Court is not inclined to grant bail to the petitioner.

Accordingly, this criminal original petition stands dismissed. 07.11.2025 stn 3/4
