PRAYER : Petition filed under Article 226 of the Constitution of India praying for the issuance of a Writ of Certiorarified Mandamuss calling for the impugned letter dated 16.10.2025 issued by the 4th respondent to the petitioner bearing Reference No.Letter No.650M/DB/JDO2/F.41(D)/2025 and quash the same and consequently direct the 4th Respondent to issue 'Site-Inspection Certificate and Working Condition Certificate' in favour of the Petitioner and provide copies of the same to the 3rd Respondent for consideration of the Petitioner's tender application in the tender bearing Ref No:06-/VBC/CUD/2025-26/ Dt.29.09.2025. Aggrieved by the rejection letter issued by the 4th respondent, thereby rejecting the tender application of the petitioner, the petitioner is before this Court.

2. It is the case of the petitioner that, with reference to the tender notification dated 29.09.2025 issued by the 5th respondent, the petitioner submitted his tender application before 09.10.2025. As per the tender notification, 6th respondent shall have to issue the Machinery Inspection certificate and Site Inspection Certificate to the petitioner on or before 16.10.2025 however, instead of issuing tender certificates, the 6th respondent had 2/4

passed the present impugned order dated 16.10.2025 thereby rejecting the tender application of the petitioner on the ground that the enclosure does not contain any details of an authorized representative. Aggrieved by which, the petitioner has come before this Court by filing a Writ Petition.

3. Learned Senior Counsel appearing for the petitioner submitted that the impugned rejection letter issued by the 6th respondent is wholly unsustainable in law having regard to the procedure adopted for such rejection and therefore, he prayed that this Court may set aside the same by allowing the Writ Petition.

4. Learned Advocate General appearing for the respondents submitted that the Machinery Inspection certificate as well as the Site Inspection Certificate will be issued to the petitioner and that the technical bid will not be disqualified. He further assured that the petitioner's tender application will be considered along with those of the other tenderers.

5. Recording the said submission of the learned Advocate General, the Writ Petition stands closed. There shall be no order as to costs. Consequently, connected Miscellaneous Petitions are also closed. 07.11.2025 Index : Yes / No Speaking Order / Non-speaking order Nhs 3/4
