ORDER
The petitioner herein, who was arrested and remanded to judicial custody on 18.09.2025 for the offences punishable under Section 64 of BNS in Crime No.612 of 2025, registered on the file of the respondent police, seeks bail.

The case of the prosecution is that the defacto complainant, who is a widow, working in the shop owned by the petitioner herein; that on 13.09.2025, the petitioner took the defacto complainant to his house and forcibly raped her. Hence, this case.

The learned counsel appearing for the petitioner submitted that the petitioner has been falsely implicated in this case and he has not committed any offence; that he is in judicial custody since 18.09.2025; and that the petitioner is ready to abide by any condition that may be imposed by this Court and sought for bail to the petitioner. 4.
The learned Government Advocate (Crl. Side) appearing for 2/4
the respondent while opposing the bail to the petitioner reiterated the prosecution case and submitted that the investigation of the case is pending. 5.
Considering the submissions made on both sides, grave nature of offence, taking note of the fact that the investigation of this case is pending and if the petitioner is enlarged on bail, there is possibility of hampering the investigation process, hence this Court is not inclined to grant bail to the petitioner.
