The Criminal Original Petition has been filed seeking to call for the records in Crime No.229 of 2023, pending on the file of the respondent Police and to direct the respondent Police to conduct further investigation. 2.
Learned counsel appearing for the petitioner submitted that the petitioner, who is working as an Incharge in Medplus Pharmacy, was brutally assaulted by six unidentified persons and therefore, lodged a complaint before the respondent Police. He further submitted that the petitioner suspects that the attack was instigated by a lady who had visited the pharmacy on the previous day and to whom, the petitioner had refused to supply sleeping pills without a prescription. He also submitted that the said lady is the root cause of the incident; however, the respondent Police are shielding her and have not taken any action against her despite the petitioner furnishing CCTV footage in support of his suspicion. submitted that the respondent Police are willfully and purposefully screening the accused and evading to secure the main accused in this case. Hence, the present petition has been filed.

Learned Government Advocate (Criminal Side) appearing for the respondent Police submitted that based on the complaint given by the petitioner, a case in Crime No.229 of 2023 was registered and that the investigation is still pending. Therefore, a direction for further investigation is not required.

Having heard the learned counsel appearing on either side and perused the materials available on record and taking note of the submission made by the learned counsel for the petitioner, this Court is of the view that the case is of the year 2023 and the investigation in this case has not been carried out in a proper manner.

In view of the above, the respondent Police are directed to conduct a proper and thorough investigation in Crime No.229 of 2023 and file the final report within a period of three months from today. The Assistant Commissioner of Police, Kilpauk Range, is directed to monitor the investigation.

With the above observations, this Criminal Original Petition stands closed.
