The petitioner herein apprehending arrest at the hands of the respondent police for the offences punishable under Sections 309(6) of BNS, 2023 and subsequently altered into Section 309(6) & Section 25(i)(a) of Arms Act in Crime No.816 of 2025, seeks anticipatory bail. 1/6
2. The allegation against the petitioner is that he is arrayed as A3. It is alleged that on the date of occurrence, A1 and A2 went to the shop of the defacto complainant, attacked him, caused severe injuries, and took away gold jewelery weighing about 3⁄4 sovereigns. The jewels were subsequently recovered. Based on the statements recorded during the course of investigation, it was revealed that the present petitioner (A3) was also involved in the offence and had acted as a gang member in securing the bullets. Hence, the case.
3. The learned counsel for the petitioner submitted that the petitioner is an innocent person and he has been falsely implicated in this case. He further submitted that the petitioner is ready and willing to cooperate with the investigation and to abide by any conditions that may be imposed by this Court. Hence, he prayed for grant of anticipatory bail to the petitioner.
4. The learned Government Advocate (Crl Side) submitted that based on the statements recorded from the arrested accused A1 and A2, the present petitioner was also involved in the commission of offence. It was further submitted that the investigation is still pending and certain material are yet 2/6
to be secured. Hence, he opposed to grant anticipatory bail to the petitioner.
5. Heard the learned counsels on either side and perused the materials available on record.

Considering the nature of allegations and the fact that the investigation is still in progress, this Court is of the view that granting bail to the petitioner, who is arrayed as A3, at this stage may hamper the investigation. Since the investigation has not yet been completed, this Court is not inclined to grant anticipatory bail to the petitioner.
7. Accordingly, this Criminal Original Petition is dismissed. 07.11.2025 kmm 3/6
