PRAYER Writ petition filed under Article 226 of Constitution of India for the issuance of writ of Mandamus directing the 3rd Respondent herein, to consider the representation sent via email dated 21.10.2025 to include the petitioner's name for admission to the PG Medical (Management Quota) under NRI subcategory in Self - Financing Medical colleges course session 2025-2026 and in the consequential selection process and pass orders.

ORDER
This writ petition has been filed for the issue of writ of Mandamus directing the 3rd respondent to consider the representation made by the petitioner through email dated 21.10.2025 wherein the petitioner has sought for inclusion of his name in the admission to the PG Medical (Management quota) under NRI sub-category in Self Financing Medical colleges Course session 2025-2026. 2.
Heard Mr.R.S.Anandan, learned counsel for the petitioner and Mr.K.Tippu Sultan, learned Government Advocate for Respondents 1 and 2 and Mrs.M.Sneha , learned Special counsel for
3rd respondent.

It is the specific case of the petitioner that the petitioner had applied under the General Category (Management quota) on 10.09.2025. In the meantime, it seems that the petitioner was taking steps to secure all the required documents to apply under NRI category. On 18.10.2025, the 3rd respondent has published a list of 265 ineligible NRI candidates and granted them time up to 29.10.2025 to re-upload the proper documents. Insofar as the petitioner is concerned, since the certificate was not available at the relevant point of time, he was not able to apply under the NRI quota. But, however, the candidates who have not uploaded the required documents were being considered under the NRI quota. Under such circumstances, it is the grievance of the petitioner that persons who genuinely did not apply because of the non-availability of the requisite certificate and were forced to apply under the general category are denied the benefits of applying under the NRI quota as against the persons who applied under the NRI quota even without possessing the relevant documents.

The petitioner submitted various representations in this
regard requesting for considering the name of the petitioner under the NRI quota. Since there was no response, the present writ petition has been filed before this Court.

In the considered view of this Court, the petitioner had consciously applied under the General Category (Management quota) on 10.09.2025. Probably, the petitioner had intended to apply under the NRI quota but the relevant documents were not available. Subsequently, the petitioner was able to collect all those documents. That by itself is not a ground to permit the petitioner to apply under the NRI quota. The concious choice that is made by a candidate will be a deciding factor while considering the admission of a candidate. The candidate must stand or fall based on such choice that was made at the time of submitting the application. Just because, there is a subsequent development where certain candidates who had applied under the NRI quota are permitted to submit their documents giving them an extended time that does not give a cause of action for the petitioner to come up with a plea that the claim of the petitioner must be considered under the NRI quota. If such requests are conceded, it will open flood gates and every other candidate will come up
with various permutations and combinations and seek for their consideration in a different category depending upon the change in circumstances.

In the light of the above discussion, the relief as sought for by the petitioner cannot be granted by this Court and accordingly, this writ petition stands dismissed. No costs. Consequently, the connected miscellaneous petition is closed.
