Sanguidha Ganesan

...Respondent

PRAYER :Civil Revision Petition filed Article 227 of Constitution of India, praying to direct the Family Court, Puducherry to dispose of the MOP.NO.511/2019 within a stipulated time frame as fixed by this Court. For Petitioners : Mr.U.Ulaga Ilakkiya

ORDER

The Civil Revision petition is filed seeking a direction to Family Court Puducherry to dispose of the petition for divorce filed by the petitioner in MOP.No.511 of 2019 within a time frame fixed by this Court. 1/4

2. The petitioner herein filed a petition for divorce on the grounds of cruelty and desertion against the respondent. The divorce petition was filed in the year 2019.

3. A perusal of the adjudication sheet filed in the typed set of papers would indicate that the pleadings of the parties are already completed and the matter was posted for cross-examination of P.W.1 as early as 04.07.2022. Thereafter, there is no substantial progress in the enquiry. Even after 3 years, the OP is still in the stage of cross examination of P.W.1. It is seen that the respondent/wife was absent continuously for several hearing dates when the matter was posted for her cross-examination.

4. Taking into consideration all these aspects, this Court is inclined to direct the Family Court, Puducherry to dispose of the MOP.NO.511/2019 as expeditiously as possible.

5. With this direction, the civil revision petitions stands disposed of. No costs.
