Respondents / Respondents This case is taken up for settlement before the National Lok Adalat. Both the parties are present. Mr.S. Udhayakumar, learned counsel for the Appellants and M/s.R.Sreevidhya, learned counsel for the second respondent are present.
After mutual discussion, negotiation, mediation and conciliation between both parties, they arrived at a compromise to settle the matter as follows:
TERMS OF SETTLEMENT The Tribunal has awarded a sum of Rs.13,13,125/-, with interest at 7.5% per annum, from the date of petition till the date of deposit (excluding the period of dismissal for default, if any). Aggrieved by the award of the Tribunal, the appellants/ claimants preferred the present appeal. It is stated that the second respondent/ insurance company had already
deposited the award amount with interest to the credit of M.C.O.P.No.644 of 2017 on the file of the Motor Accident Claims Tribunal (Special District Judge, Dharmapuri) and the claimants have withdrawn the same, as per the apportionment made by the Tribunal.
2. After due deliberation and consultation, both the parties have agreed to settle the award to a sum of Rs.8,00,000/- (Rupees Eight Lakhs Only) over and above the amount awarded by the Tribunal, as full quit compensation, inclusive of the interst.
3. Hence, the second respondent/ insurance company is directed to deposit the enhanced amount of Rs.8,00,000/- (Rupees Eight Lakhs Only), arrived today, within a period of six weeks from the date of receipt of a copy of this order, to the credit of M.C.O.P.No.644 of 2017 on the file of the Motor Accident Claims Tribunal (Special District Judge, Dharmapuri) and on such deposit, the appellants/ claimants are directed to withdraw the same as per the apportionment stated below.

5. The Tribunal is directed to transfer the above said award amount to the Bank accounts of the appellants/ claimants by way of NEFT / RTGS, on proper identification, in accordance with the terms of the award, without insisting on any formal permission petition.
6. The Civil Miscellaneous Appeal is disposed of accordingly. No costs. Consequently, connected civil miscellaneous petition is closed.
