O R D E R

The Civil Revision Petition is filed challenging the order passed by the Trial Court dismissing the application filed by the petitioner/plaintiff seeking amendment of the plaint in I.A.No.03 of 2025 in O.S.No.32 of 2024, dated 25.06.2025.

2. The petitioner/plaintiff filed a suit for partition against the respondent. Now, the instant amendment application has been filed so as to include 4th item in the suit schedule and also to amend the prayer to increase the share of the plaintiff as 2/3rd instead of 1/2 as prayed in the original plaint. However, the petitioner failed to seek amendment of the valuation column suitably. If 4th item is included in the plaint, the valuation of the 4th item should be added to the value of the suit property.

3. Likewise, if the share of the plaintiff is increased to 2/3rd from 1/2, the value of the share should also be suitably increased in the valuation column. Since the petitioner failed to seek amendment of the valuation column suitably, the Trial Court had decided to dismiss the amendment application as the same was defective. I do not find any error in the order passed by the Trial Court in I.A.No.03 of 2025 in O.S.No.32 of 2024, dated 25.06.2025. However, if the petitioner is so advised, it is open to her to file a comprehensive amendment application with prayer for amendment of the valuation column also.

4. With this liberty, the Civil Revision Petition stands dismissed. No 2/4
