ORDER
The petitioner, who apprehends arrest at the hands of the respondent police for the offences punishable under Section 303(2) of BNS, Act and Section 21(1) of Mines and Minerals (Development & Regulation) Act, 1957 in Crime No. 336 of 2025, seeks anticipatory bail. 1/4

The allegation against the petitioner is that he was involved in the transportation of three units of savudu sand, illegally quarried from Thirumullaivoyal Village near Pachaiyamman Temple and on interception by the police officials, he produced a bogus transit pass for the transportation of sand. Hence, the complaint.
3. The learned counsel for the petitioner submitted that the petitioner has been falsely implicated duly on suspicion. He further submitted that there was no illegal transportation of sand and hence, he prayed to grant anticipatory bail to the petitioner.
4. The learned Government Advocate (Criminal side) for the respondent police reiterated the prosecution case and submitted that three units of savudu sand have been seized and the transit pass receipt produced by the petitioner is fabricated. He further submitted that the investigation is still pending. Hence, he opposed to grant anticipatory bail to the petitioners.
5. Considering the manner in which the alleged occurrence took 2/4
place and the fact that this petitioner not only illegally transported sand, a bogus transit pass was also produced, therefore, this Court is not inclined to grant anticipatory bail to the petitioner.
